Women of Caliber General Release Form (Please Read)
By signing electronically, Participant agrees that this digital signature carries the same legal validity as an original handwritten signature on paper. Participant acknowledges that they have the right to sign a physical copy of this agreement and may request one at any time. By proceeding electronically, Participant voluntarily waives that right. A copy of the signed agreement may be requested in writing at no charge. This consent remains in effect unless revoked in writing, and there is no penalty for withdrawal. Participant agrees to keep a current email address on file for any necessary communications. By signing electronically, Participant acknowledges that this agreement has the same legal force as a signed paper document.*
By signing below and in exchange for the opportunity to participate in an Women of Caliber (“WOC”) event, the undersigned (“Participant”) indicates that she or he has carefully read and understands this Women of Caliber General Release, and acknowledges and agrees to the following items, on behalf of Participant and their heirs, guardians, representatives, successors and assigns.
a. Eligibility and Consent. Participant is at least 18 years of age, mentally competent and medically able to agree to the terms of this General Release. If the Participant is under 18, the parent or legal guardian named below grants permission for the minor to participate in WOC events and agrees to all terms of this General Release on the minor’s behalf. The parent or guardian acknowledges that this agreement is made voluntarily, with full understanding of its terms and legal effect, and intends for it to be binding to the fullest extent permitted by law. The parent or guardian further agrees to indemnify and hold harmless Women of Caliber LLC and its affiliates from any claims, liabilities, or damages arising from the minor’s participation in WOC activities.
b. Firearm Legality and Rules. Participant is legally permitted to possess and use firearms and other related equipment (“Firearms”), whether as part of an WOC event or otherwise, and is capable of using Firearms safely. While WOC encourages all Participants to be familiar with and comply with federal, state, and local laws, WOC does not provide legal advice or certify the legality of skills taught or demonstrated during events. Participant is responsible for determining the requirements of all applicable laws as they may relate to ownership, possession and use of Firearms, and remaining in compliance with such requirements. Participant will follow the policies, procedures and rules of WOC, including the policies, procedures and rules of the venue where the WOC event takes place. WOC reserves the right to revoke Participant’s right to participate in an WOC event at any time for any reason.
c. Firearm Condition and Responsibility. Participant certifies that their firearm is in safe working condition and has, to the best of their knowledge, received any recommended or available factory safety upgrades. Participant accepts full responsibility for firearm’s operation and for ensuring its safe handling at all times. Participant agrees to release, indemnify, and hold harmless Women of Caliber LLC, its staff, instructors, volunteers, and sponsors from any and all liability, claims, or damages arising from the use of this firearm during WOC activities.
d. Risks and Behavior Standards. Participant has made a fully informed decision to participate in WOC events, understanding that inherent in the nature of such events and the use of Firearms is the potential of serious property damage and physical injury, up to and including death. Participant understands that the use of Firearms may involve risks (unforeseen or otherwise) and that Participant is responsible for their own safety and behavior, including but not limited to the use of appropriate personal protective equipment and refraining from the use of substances that may alter Participant’s mental state. Participant is under no obligation to attend or participate in any WOC event, and is permitted to decline participation or attendance or continued participation or attendance in an WOC event at any time for any reason. WOC reserves the right to remove any Participant from an event due to unsafe, inappropriate, or disruptive behavior, at the sole discretion of WOC personnel.
e. Health Risks and Medical Consent. Participant understands the hazards of coronavirus and similar infectious diseases, and accepts full responsibility for self-compliance with the most recent CDC guidelines. Notwithstanding the risks associated with infectious disease, Participant hereby willingly chooses to participate in WOC activities, acknowledging and fully assuming the risk of illness or death arising from participating in the activities, arising out of or relating to infectious disease, illness, or any transmissible condition, including but not limited to COVID-19 or any other illness or injury. Participant authorizes WOC personnel to seek emergency medical care in the event of injury or illness.
f. Release of Liability and Indemnification. Participant waives, releases and forever discharges any rights, claims, demands, or objections which Participant has or which afterwards may accrue to Participant against Women of Caliber LLC; its affiliates, sponsors, partners, or licensees; or any of its officers, directors, employees, facilitators, volunteers, agents, representatives, personnel, assigns or successors (past or present) (the “WOC Parties”), including for any physical injury, death or property damage, in connection with their participation in an WOC event, regardless of the cause of such rights, claims, demands, or objections. Participant understands that this General Release is intended to discharge, release and waive any and all claims, damages, and liabilities arising from their participation in an WOC event, even if such claims arise by the negligence of WOC Parties. Participant agrees to indemnify and hold harmless the WOC Parties from and against any claims, damages, and liabilities that Participant had or may have for personal injury, death, or property damage arising in any way from participation in an WOC event.
g. Media Consent and Usage. WOC may designate personnel to capture photographs and recordings of Participant during an WOC event (“Media”). Participant consents to WOC’s unlimited use of the Media for unlimited time in all print mediums, or other media of tangible expression (including the Internet and/or forms of social media), as WOC may elect and without payment of royalties or other compensation to Participant. Participant waives the right to inspect or approve the finished materials in which the Media may be exhibited, published or distributed. All Media is owned by WOC, and WOC may register any copyrights or other intellectual property rights in the Media. To the extent Participant has any copyrights, rights of publicity, or other rights in the Media, those rights are assigned to WOC. WOC may, at its sole discretion and with WOC’s express authorization, grant permission for third parties, such as media outlets or partners, to use/own captured Media. Participant waives all rights or claims in any media or material using Participant’s name, photograph, voice persona or likeness contained in the Media. WOC is only responsible for Media captured by its designated personnel; other participants in WOC events are responsible for obtaining their own permissions and Participant understands that WOC has no control over those participants. Participant understands that their image may appear incidentally in group photos or video footage and agrees this does not require individual approval or notification.
h. General Provisions. If any provision of this General Release is deemed invalid or unenforceable, it will not invalidate the remaining provisions of this General Release. WOC’s failure to exercise any of its rights under this General Release does not prevent it from exercising such rights at a later date. This General Release contains the full and complete understanding of WOC and Participant with regard to its subject matter and supersedes all prior agreements and understandings, cannot be modified except in writing signed by both Participant and an authorized representative of WOC, and is governed in accordance with the laws of Ohio, without regard to its conflict or choice of law provisions. Any dispute arising from this General Release or participation in WOC events shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. Venue shall be in the State of Ohio. This General Release will remain in full effect beyond the conclusion of the Participant’s involvement in WOC events.
